Need some advice

Need some advice

Ok let me first start out by writing out how many times i've brought my car in for this issue:

March 2nd 2011

And finally December 30, 2011.
I've been in touch with Infiniti consumer affairs about this since right after the October 31st visit where not only did they not fix it AGAIN but they damaged my car in the process as well. Pieces of the windshield cowl were not in place/cracked/dented and the interior below the steering wheel was all scratched up, same with the washi trim to the left of the steering wheel. I reluctantly agreed to take it to the same dealer one last time for the December 30th visit where the service manager took care of me. I got a loaner for 2 days and he calls me up to tell me he doesnt hear anything and he thinks its fixed, but to call him to let him know how it went. I go pick up my car and the first tiny crack in the road i hear that **** again. My question is do you think it would be unreasonable at this point to pursue the NYS lemon law? Or should I call the service manager up first and try yet again to get this fixed? Call consumer affairs pissed off and threaten to file for lemon law? Drive it off the verrazano bridge? What would you guys do

If they can't fix it and it's under the law, go for it. I'd tell them you are going to call about it first.

Yea the lemon law here states 4 or more times for the same issue is enough.. idk though if I should bring it back again

For the creaking right? How many dealers have you visited?

I don't know if the lemon law applies to squeaks and rattles. I always thought it was for safety related issues that are not fixed after three or more attempts.

I personally would just turn up the radio or try another dealer.

yea, listen from 1:20 to the end thats an everyday experience for me. I actually spoke to a family friend today whose a lawyer and she said i have a good case so we'll see

It is not acceptable for a $40k+ car to creak like that. I would give them only 2 choices, either fix it or take the car back. I believe it is a reasonable demand.

^+1 I think thats what im gonna do at this point enough is enough. Time limit for lemon law is the length of the warranty. 8 times for a rattle? seriously infiniti? it could be such a great car but im absolutely disgusted with it now. maybe now's the time to take a look at that new c63 coupe..

Here's the NY lemon law as of 2010:

The New York Lemon Law applies to new cars, both purchased and leased, which suffer a nonconformity; a defect or condition, which substantially impairs the use, value or safety; that has been addressed a substantial number of times (normally 3-4) by an authorized manufacturer's dealership. This nonconformity must first occur within the first 24 months or 18,000 miles, whichever comes first. The New York Lemon Law also applies to vehicles that are in the shop for repair thirty (30) or more calendar days during the first year.

new york lemon law you can try but expect to dish up some lawyer fees...

your best bet is just stay in contact with Consumer Affairs directly...
