If you want to do a lawsuit, you will need to be one of the big people, with massive amounts of time and money.
Reprogramming hopefully will take care of this. Check your date of manufacture...if it is before April, 2009 for a '09 G37, maybe the software did not get the latest revision to solve the "idle surge" which may be related. It helped my G to react properly. Before that, I had intermittent problems (always the hardest to troubleshoot) of rpm surge after letting off a highway acceleration, and when slowly coming into my garage.

Mine is not an "X" model but is a very early model 2009 which apparently included some of the leftover parts, etc. from the end of 2008 production. Recently my entire front brake system was replaced under an ITB that applied to only 2008 models since my 2009 had the faulty 2008 brakes.
I say that only to say that if they had problems with surging in the late-2008's its entirely possible (highly plausible) that it also spilled over into the early 2009's as well. I have experienced this surge issue twice that I can remember and it is like holding back a raging bull when it's in its lowest gear which makes it doubly difficult but fortunately no accidents here (knock on wood).
Lawsuit...doubtful but it sure would be nice for Infiniti to step up and fix the issue. As far as a big announcement, doubtful unless the government makes them especially after seeing the whack that Toyota has taken over its gas pedal / acceleration problem. My guess is they (Infiniti) needs to tweak the program on the tranny yet again to get it synched up with the conditions under heavy/sudden braking.

I just picked up my car back from the bodyshop this morning. The guy from the body shop who picked me up from home told me he experienced the engine surge when he was braking for a traffic light after he went to wash my car yesterday.
Ever since the accident, I always have my right hand on the shifter when coming to a stop. I now always make sure I am stopping at least 10 feet away from the car in front. It is no longer a relaxing thing to get behind the wheel of this car. Mentally, I always tell myself it may happen again at the next stop.

FWIW, now that I finally have my G (the 10th or 11th car I have owned), I can report that last evening I managed to depress the top of the accelerator by mistake as I was braking due to my foot being on the far right side of the brake pedal. I have large, but not huge feet. This is the first time this has ever happened to me in any car. It certainly explains the unexpected surge when you think you are only braking. I will be more cautious going forward now that I realize the pedals are designed/placed in this manner.
huh - this is first time I stumbled on this thread - coincidentally, tonight I started my car with my foot on the brake; took it off, let off the parling break, put my foot back on the brake, pretty hars as I was on a steep driveway, and the car's RPM suddenly surged to about 3k for no reason - I though I must have put my foot on the accelerator at the same time I put it on the brake, but I don't think that was truw - would have been really hard to do. I just shrugged it off. Hmmmmm - I was just making fun of Toyota to a freind of min a bout 2 hours earlier. Might need to go and get that G8 GT I was looking at on Tursday....390 torque...mmmmm...no accelerator problems, just problems everywhere else.
I have a late production 2009 xS sedan (Oct 2009 mfg date)...I've really only noticed the RPM surge when breaking while using the DS mode, don't notice it when I'm in normal D mode...plus it only occurs when I'm decelerating around the 30mph mark and it's an RPM surge, w/ no surge in acceleration...hmmm...perhaps it's the downshift rev-matching kicking in? I don't think it's the hard 4-3 downshift issue b/c it only notice the RPM surge when in DS.

With the angle of the accel pedal you can definitely hit it with the heel of your shoe when you rotate your foot left and press the brake pedal. I've never noticed this with other cars I've owned (Integra, 4Runner, Maxima, Altima, A4, Ram1500, Accord, 944, 911)
I haven't looked at it closely but it might be too horizontal and out of plane with the brake pedal. As you depress it, your shoe hits the bottom of the accel pedal. It's happened to me a few times on my 6MT. No forward surge or anything but I have definitely pull up to a stop light, come to a full stop, and had the engine spinning at about 2K RPM. As soon as I pull my heel off the accel the RPM drops. It's very hard to feel in your foot because it's not the top half of your foot where you would normally feel something like this.
