Need some legal advice as well

Short story

I have spare wheel, which had a tire removed from a Tire shop in Clarendon, VA. So I pickup the wheel and did not notice till the next day that the technican scratched my wheel. So I go back today to talk to the store manager. He said that the tool they use it is impossible to scratch a wheel. So basically we proceeded to get into an argument. If you look at the scratch which goes almost half way around the wheel. It was caused by the dismounting of the tire.

My question is I would like to take this to smalls claim court. Anyone have experience with the process of filing a claim?

First you need to go over his/her head. Offer them to use the wheel to do the same proceedure again. It's damaged already, so who cares if it gets scrathed more. If they won't do that, talk to a lawyer and get them to next write you a letter threating leagal action. After they recive the letter from a Law office they will settle. If it goes to court that's bad publicity and time away from there work. They have insurance just for these types of problems. They will first try and turn you away thinking if they don't take blame you will leave. If you press a little harder they will give.

Thank you for the advice. I already made a formal complaint with MONRO Muffler. They will get an investigator to check out my wheel and to follow up with the store manager. I will definitely follow up with my lawyer, if they concur with the store manager.

I already have a 2 page document stating the events and happenings. Should I provide this detailed story to MONRO Muffler's investigator or Should I hold off?

Let me know,

TIA

I would forward a "copy" to the investigator. No sense in letting him/her try and get just one side of the story.
