New G 37 in an accident
I have 2100 miles on my new G 37XS.
Went to run an errand to the local shopping center. Looked for an out of the way place. I parked one empty space from a little old lady unloading her groceries from her shopping cart. I purposely parked "up the hill" because I was afraid she'd leave the cart and it would coast down and hit my car. One of my biggest pet peeves is people who are too lazy to put the carts where they got them so as not to do damage to someone else's property, but I digress.
I was in the store less than 5 minutes and came back out and the lady was standing there looking at my car along with 2 other guys who were doing lawn care. When I approached my car she asked if it was mine and she said, well I hit it. I thought that it would be a scratch. Then I walked around the car and she had bashed in the rear quarter panel behind the tire on the passanger side.
Total estimate $3,000 plus or minus. The body shop is waiting for a bumper cover for the car and it will be finished.
Good news: she was kind enough to wait, maybe it was that the 2 guys saw her do it, but I don't care at this point. Her insurance is picking up the entire cost, no question. And no one was hurt.
Bad news: I'm in a rental.
Question: What about deminished value, does the insurance company have to reimburse me for that?
Once I figure out how to post pictures I will post them am I remedial or is it unnecessarily complicated?

Diminished Value is probable in many states. Depends where you are and how you negotiate it. There are some good sites on the 'net with more info.
Don't forget Loss of Use. Even if you have a paid rental, chances are it ain't a G.
IMHO, the old lady probably would have let you know she hit your car even without witnesses. It is a valued trait of her generation.

what really stinks about the situation is that now it will show under carfax, so when you try to trade car in, they will utilize that to lower the amount they will pay for the vehicle regardless of how flawless it is at time of trade.
Thanks for the information. First, the body shop is first rate, I have used them before on several different cars. No I am not in a G as a rental, I'm in an Altima.
I agree about the lady that hit me, she is from another generation, and they, in general, had a better sense of what seems to be missing from many people these days. I actually was surprised that I didn't blow a gasket and start screaming at her. Can you imagine screaming at your grandmother? I cannot. Maybe I can learn a lesson from this myself...

All disclaimers apply… IMHO, In many states, the at fault party is responsible for the rental value of your G for each day you have "loss of use". That loss is offset by any rental costs paid by the insurance / at fault party. So Altima $30.00 a day, G $100.00 a day, you get $70.00 a day plus $100.00 a day for any day you didn't have an Altima, paid by the at fault party, or your G. In my experience, it doesn’t matter if you rent a replacement or not, you are still out your G and they owe you the rental value of that G. It can get to be some real $$ after a month or two. (Don't ask how I know.;-)
Believe it or not, sometimes adjusters will [try to] reject that part of the claim. Well, I guess some adjusters would try to reject all parts of a claim, at least at first. ;-)
