You do not have a lemmon until you meet the strict requirements of the lemmon law for your state. They are based on the days of downtime and number of repairs for the same material incident.

Suggestion, let them fix it. If they change the AT, no harm done. In my 2006 Porsche 997, at 5000 miles the clutch started squeeling. Porsche changed the whole clutch assembly. No lemmon.

wow, 70+ miles on delivery?! That seems a lot to me. Mine had 13 miles.

IMO, if the dealer is offering you to change the car, change it!

So I picked it up today. They fixed the problem. Apparently it was a sensor issue and they just replaced it. The car drives perfectly.
