Throttle lag class action suit
I may be wrong but I've experienced something similar to this but I don't think it is throttle lag. When in Auto DS mode, I've had the car downshift into first gear at a really bad time similar to his explanation, at a slow yielding intersection. It hardly caused an accident but it did freak me out a little because when I hit the gas it took a couple seconds to actually start accelerating again.

Like someone flipped a switch, uprev tune did not get rid of it.
Scared the daylights out of me on more than 1 occasion.
Took it as a sign to dump the g.
I even took my gen 3 completely off & cleaned the filters like a maniac.
Turns out, it's the transmission.
Shame, I was real attached to that car.
I have spoken to the dealership about this to be exact 3 of them. It is a safety/Economy programming feature. If you quickly rev the engine and then let off it stalls to makes sure you launch into someone. and at low speed it jerks the car forward to save the engine from extra work. That was the explanation I recieved from a tech.
If the guy wants to sue let him sue... Sometimes you guys get too hung up on what it is other people want to do, who really cares. People do what they want to do anyway so, let em go ahead. Cannot control others actions.
There's certain things I'd let slide with that kinda mentality but not everything.
This was definitely an issue on my 08' G37s. Unfortunately, she got totaled last month, but my 2010 seems to not really have this issue. I always experienced it when you went around turns or bends at a good pace and tried to get on the gas to accelerate out of the turn. There was always a 1+ second lag and then it would jump forward with accel. I always thought it was the VDC or some stabilization function that was not engineered well.
I've had this issue occur occasionally since I bought the car brand new back in 2009. Its a 37x sedan with 7AT. I've it re-flashed, but every once in a while I'll put my foot to the floor and it will not down shift.
So OP, it's been about 2 months. How is it going with this? No updates? How many in the class so far (if the attorney has told you)? Have your attorneys even contacted Nissan about it yet? Any response at all from them?
i know exactly what the OP is talking about...i've experienced it myself as well....there are times where you have to accelerate quickly to get out of a hazardous situation, and i've had times where the throttle lag was so bad that I literally **** my pants cause i was gonna get rear ended or t-boned, etc....
this is much more evident in automatic than 6mt tho....if you have a 6mt, u might not know what we're experiencing or talking about....

i got the transmission upgrade too....it's not really a "transmission" upgrade...to me, it almost seems like they reduced the traction control more than changing the transmission specs....regardless, my 5at still has throttle lag
bro all im going to say is put a ground wire on your car and you wont have a problem ever again....
