Court Date Tommorow - Your Advice Needed
Yeah, so most of you know about the "UNNECESSARY SPEEDING" ticket i recieved a while back in MD. I got cited for doing 93mph on a 65mph zone.. and i am 100% positive i wasn't at that speed. I could have just paid off the fine, but i want to go to court and try to fight this out myself, the ticket is $275.. so i guess its worth fighting. for ya'll who dont know the situation, i was coming back from Canada, driving on 270 Southbound... minding my own business with my little sister sleeping in the backseat and my mother in the passenger seat, I was very tired and just wanted to get home.... i was at about a 70-75 mph Cruise Control... when suddenly this modded Mazda miata starts taunting me into a race... I totally ignored it ... and just kept driving at my pace... after a couple of miles, i see lights in my rear view, so i slow down... thinking the cop is going for the Miata who btw is doing like 100+ at that point ... as he passed me while i was doing 70mph a couple of seconds back as if i was standing in one place... the cop pulled me over ... said he clocked me at 93 and i told him he got the wrong guy..... he said "I was trying to pull him over as well, but he didn't stop and you did and you were speeding as well" .. my mom even told him taht she was watching over my speed and there is no way i was doing 93 ... he said he had it on his radar and then he says "dont worry, the points don't carry over... its just a fine" .... which later i found to be BS. my mom offered me to pay this ticket off and forget about it ... i mean .. if he gave me a ticket for doing 75 mph on a 65 i would have accepted it .... and not complain about it ... but i think he just went for the easier target which was me .. so tommorow is my court date... i've never done this MYSELF.....any advice? ... LOL...or better yet tell the judge to F off and if that cop got you going only 93 he must be smoking crack because you were doing at least 110mph.

Damn, seems like you got screwed bro. Good thing is you have a witness, your mom. I've been in a VA traffic court and they don't really let you explain your case in front of the judge. Probably because of the amount of cases that day. You either plead guilty or not guilty. On the day I went, the judge was nice to almost everyone there and most who pleaded guilty to 15-20mph excess in speed got off with no points if they opted to take drivers class and only paid court fees .
In MD courts, a witness tends to go a long ways though from what I've heard so make sure your mom is there. Otherwise it's your word against the cop. Just explain that you were going X speed on cruise control while another car passing you was going 90+mph trying to provoke you in racing. Tell the judge the cop also told you he assumed you were both going those speeds but since he was using radar, there is no proof that you were the one speeding. Only laser could have determined that and he wasn't using laser. If needed, have your mom testify you were only traveling 70mph and also witness the other car passing you while the cop stated he "assumed" both of you were racing. If the judge won't allow you to plead with an explanation, you might be able to speak with the state prosecuter and plead to a lesser offense and take driving class. You definately don't want to be stuck with 93mph in a 55mph zone. That's like throwing money at the insurance company.

What he ^ said. I would also add that there is a term, I can't remember it, but when the judge asks for your plea you tell him that you want to talk it over with the prosecutor first. Then after everyone has entered their plea you talk to the prosecutor with your mom and explain the situation. He may just ask the judge to dismiss it.
The power lies with the prosecutor. If you have a good record, and he'll know cause he'll have a copy of it, then he may just dismiss it. The judge just takes advice from the prosecutor.

Not sure what you plan to plead. If you're going not guilty and try to prove the officer messed up. Try to discredit his radar/laser device. I think he will start by sayin that he's a certified operator and what not and might even say that the unit was calibrated before his shift.Have him provide proof of the calibration since i think they're suppose to keep record.Have you mom come with you as a witness and have her testify that you were not doing 93 and have her say how she would never allow you, her young son to drive that fast with her in the front seat (or the car). Chances are the judge has kids and would agree that he/she would never let his/her own kid drive that fast with them in the car. Have her testify what the officer said you to regarding the miata. It seem like he assume you were going as fast as the miata and wrote you up for what he clocked the miata at. Not sure how their radar system works, but state that there was a faster moving miata that was next to you around the time the cop clocked you. The judge may question the cop if this was true of which he will say yes. Chances are he's not going to lie to the judge, if he does make a big fuss that he's lying since you have your mom to witness. I think you have a good chance to discredit the radar reading as operator's error. I don't think radars are that inaccurate, if he had calibrated them. Either that are you're just in denial that you were going 90+

been there done that, i pleaded not guilty, they gave me trail. i was like i know i didnt go that fast, there must be miscalibration with the instruments. the officer who got me was like, your honor i always calibrate my instruments carefully blah blah blah. shes quite hot btw, anywho, it was my words against hers. I was found guilty and had to pay neways but no points on my record. I wanted to say, "you want the truth??? you cant handle the truth" but it was a pretty serious situation and i was too chicken to say it

ya, you have your mom as a witness and u look like a teen...o wait you are one..lol. just plead your case that the car next to you 'miata' was doing the speeding. you can also say 'your honor i was going about 5-7mph OVER the limit, but nowhere near where the officer clocked me'. i had my mom and my sister w/ me, blah blah blah.....i throw myself to the mercy of the court. hahaha lol, ok that last part was for kicks. But Def plead not guilty and stand confident, up straight, chin up looking directly into the judge's eyes and officers eyes. dont lower your head or back down either and NO hands in pockets!! the bailiff will make sure you keep em out lol...O and you cant wear a baseball cap either, so dont go to court lookin like fabolous in that holla back video arjun!! loool
