Question Need Some Legal Advice

A cop pulled me over yesterday for speeding...he said i was doing 41 in 25 mph zone on the radar...but i KNOW for sure that i did not go over 30 mph..One because i drive thru the road where the cop pulled me over everyday for the last 1 1/2 year... i've seen cops hiding around there quite frequently so i would never go over 35 mph...there also an elementary school where kids always crossing the road...Plus that day, two cars flashed me coming from the opposite direction == so i automatically take extra precaution cuz you know there's a cop up ahead...I told the cop that YET he still gave me a ticket (my first one ...)The question is whether if i should just pay the fine or go to court and try to fight for it using my words against his (with his bull**** radar). I'm only 19 and the cop always have something against young drivers

This is in Vienna by the way...for all i know Fairfax county could give me more s*** for wasting there time

I bet I can name where you got pulled over, right near on 123 coming from Tysons Corner to Vienna just before see the "welcome to vienna" sign.

I doubt that you will win if you fight the case. It's really not that severe. You should go to court however, the judge may let you off without any points. Plus it's your first ticket.

Go to court. Tell the judge exactly what you just explained to us. Almost word for word. Tell the judge that you know the area VERY well and you know it is patroled often. Then tell him you where aware of the officers presence because of the vehicles passing where flashing their lights just as you explained to us. He/She may see your point and give you the pass. If all else fails , he/she will problably knock it down or give you PBJ.

Pretty close...i actually got pulled over on Old Courthouse off from 123

Is it really a good idea to tell the judge word for word? Should he be knowing that you were already speeding and then saw people flashing their headlights so you slowed down. Is it remotely possible the cop got you really at your estimated speed before you slowed down through the trap?

If you really wanna get off the best way I know of is to find a mechanic (who is also a good friend or a friend) to write you a work order/invoice for speedometer calibration stating that your car's MPH was inaccurate. You can take the work order receipt to the judge showing you had the error fixed (although it may be speculative on a 2005 G35 ) The work order should show speedometer calibration and like that your speed was off by a certain degree. I know many people who have gotten off with this type of case.....just my $.02

You didn't say you were speeding, you just saw vehicles passing by flashing their lights at the "vehicles in the area". I think if you took this approach you would a: Acknowledge that you know the area and would be stupid to abuse the speed limit in that area, and b: what dummy would speed when vehicles are warning people of the upcoming speed trap. You have a clean record, so your history of being a good observent driver will help this story. But this is just my opinion. The speedometer thing would problably work too.

IMO the telling the judge you 'knew' might not work. Thats like stealing candy from a 7 eleven then telling the judge, but I knew the camera was recording, I just wanted to see if I could get away w/ it. In other words I dont think it matters that you know there are cops around b/c the fact of the matter is you were going over the limit. As long as the cop can produce data with what he clocked you at...and of course depending on the judge...i wouldnt take this approach. The only way id waste time going to court is if i have VALID proof and in this case its just your word against the officer. An alternate method which I know can work is to call the court and throw back your date. Do this once maybe twice and the cop will most likely NOT show up on the second rescheduling. Again, thats not a guaranteed way to avoid the ticket.

Well it sounds to me that you are assuming Guilt before Innosence. What you are proving is that with your previous "good driving record" and knowledge of the speed trap why in the hell would you speed. Keep in mind that the judge is a driver too. I know they never get tickets, but i'm sure they've seen people flash headlights at cars and even they slow down for speed traps. If anything it will entertain the judge and maybe he/she will let you off. I personally get lawyers to fight my tickets. My last went from a wreckless driving ticket to a defective equipment ticket. That started to be a 6point $2500 fine with possible jail time, and that ended up being a $200 no point, not even reported to the DMV ticket. Lawyers are great , but pricey. Lawyer was $400.
