Interesting you mentioned it grinds at 5th gear. I have a 2010 and at about 10k miles, the same thing started happening. Anytime I went into 5th gear it would grind. Got it replaced under warranty. The service rep stated this happened a lot in the 04/05 models.
Just sold our '03 yesterday with 90,000 miles on it. Purchased it new in '02 and had some factory warranty issues initially, since it was the early debut model. Other than routine stuff after warranty period, we only had to replace the throttle body at about 80,000. It was a great car...that's why we bought another one!

it was very seldom when it grinded. when it started happening i would just usually just go from 4th to 6th and skip 5th. i had to take it into the dealers about 3 or 4 different times for the service rep to actually have it happen to him and feel what it was doing. im just glad it was still under warranty. at that time i thought our powertrain warranty ended at 50k or 60k.. so i thought i barely beat the deadline.. but our powertrain warranty actually expires at 70k. that was a relief. i also had a 2003 g35 coupe with no problems what so ever.. granted it was an 2003 with about 40k at the end of 2008 before it was totalled.

Thanks for the sympathy. It wasn't too big of a deal actually. I brought it into the dealership, confirmed the problem with them, and it was taken care of in a few days. The whole process was fairly straight forward given it was under warranty so it didn't bother me much. I rather it happen early on than near end of the warranty term or even worst after the warranty expired like you mentioned. I was impressed the the service that was provided. I went from an Acura, to a Subaru, to now Infiniti and definitely appreciate Infiniti much more - granted it comes with the territory of a "luxury" brand.
Our 07 that we sold to a friend now has 65k and other than TSBs it's been trouble free. Our 09 has almost 20k and no problems either. Both have serious sucky-paint issues though
