You insurance policy should have a "uninsured motorist" clause ... you won't be out of pocket other than your deductable but it will be you filing the claim (not the other person) so it counts as a claim you made and the posibility of your insurance going up.
Do you live in a state which requires auto insurance policies to have uninsured motorists? I went through something similar in va and my auto policy acted as the uninsured motorist in the accident because he did not have coverage.
If the other driver is at fault your insurance should not go up at all.
Also be sure to get deminished value on your vehicle

Don't think that matters ... boils down to $$ ... since his insurance company is paying the bill it's his claim. The claims you make (regardless of reason) start to rack up and go against your premiums possibly increasing.

Deminished value how do I do this , sorry for the lack of knowledge I've never been in a car accident so I have never dealt with insurance
It may depend on the state. But if the other driver is at fault your insurance premiums should and will not go up. Especially if it is with an uninsured motorist.
