If you have rental coverageon your own policy I would subrogate and let your insurance carrier handle all of the red tape with the opposing carrier. You'll have to pay your deductible up front (qhatever is on your policy) but once that is collected you will get a check to reimburse you for it.
Try not to fret over it (easier said than done I know) just take everything in stride and like someone else said don't settle- it wasn't your fault so you shouldn't have to.

I remember when you first posted your crashed G35 on Driver last year.
Damn these drunk drivers!!
I can't imagine how you felt driving it home and seeing pieces of it flying off.
Hope they total it.

I would put the factory wheels back on the car if you think that they may total it. They will take the car with your aftermarket wheels. If you don't have GAP insurance , you may owe more than what they pay out for the total. You could then sell your custom wheels to help offset some of the costs out of your pocket. Just a thought??? And as you can see, everyone on here feels really bad about your mishap. Hope all works out for you.

Yeah, but either way, despite the annoyance you go through now, considering it isn't your fault you should end up just fine in the end--either your car all fixed up or a brand new one.

the only thing I hate about switching into a new veichle is having to mod all over again..... its a labor of love but having to do it again because of someone else ... ouch... that stings.

Well good luck with your claims, It seems pretty cut and dry whos at fault, for your own easy claiming it on your own policy will get the ball rolling and at least get you back to driving. You'd just have to do without your deductible for a little while.

yeah i'm thinking about doing that....i called her insurance(kemper independance?) several times and left a few messages and still no response! its getting me more and more aggrivated. If i don't get a call by today, i'm just going to go with mine(Geico).

and also, thanks everyone for the kind words! now its just the waiting game!

Oh they'll listen when they get a call, "Hi this is so and so from Geico subrogation department, we are looking at a lawsuit for claims made in the amount of $XXXX.XX, less our attorney and legal fees, do you wish to settle or go to trial?" You'll see checks flying out of Kemper!! Geico is pretty good in handling claims from customers feedback i've heard.

Ouch..... that blows! Crazy drunk bit**! If the frame is bent, which it looks as if it is, hopefully they will total it. If they fix it, she may never feel the same.
