Called the dealership. The story ...

Basically this is a brand new car (never sold/used/pre-owned) with a repainted hood that got scratched during transport. Infiniti can't sell it as a new car, so after they had their preferred/authorized shop repaint the hood, they auctioned the car, which is where this dealership picked it up.

Car was produced 12/07 and warranty expires on 8/12. No part of the warranty is affected. Looks like the auction expired, but they will re-list with a buy now price of <$36k. I'm sure it could be had for <$35k with free ship to anywhere is US. MSRP is $44k. Nearly $10k off for a scratched hood.

Hmmm ... I'm really licking my chops now ...

pretty cheap. i know times are bad for dealers. local dealer has new escalades advertised for $33,000.
