Got in an accident...who would you say was at fault? (VIDEO)

Hey G37 fam....

It’s a sad day. I didn’t have a ton of mods but maan I loved this car. It was the first one I bought with my money and I always tried to keep her clean in these nyc streets. I learned a lot from this forum and I tried to do what I can to give back by helping others who may have had simple questions that I could answer ( granted im still a bit of a noob, so i could only really answer non technical questions)

Simply put, I was pulling out of the drive-way onto a One-way street. Then came the white beast. No one was hurt, thank God for that, but my 08 is likely a goner.

This is the video that was submitted to my insurance company. (GUYS! Although this is a video from a home, please please invest in a dashcam; no one can question a video evidence)

I don’t wanna sway your opinion (even tho this is a g forum), but feel free to leave a comment on the youtube vid stating your opinion, as this will be evidence submitted to both insurance companies. My insurance company asked that i upload it to youtube so it is easily shareable. You think it’s a bad idea, that i made it public? Would that bite me in the ***?

What was the guy's reason for going wrong direction on a one way street?

I suggest backing into the driveway in the future. It takes a little more effort to park but saves headaches.

Just my 10¢ here, bit in my opinion the van is clearly at fault. Not only was he traveling in the wrong direction on a one-way street, he was clearly exceeding a safe speed to be in reverse gear.

Now, because you (Infin88) were entering the flow of traffic by backing out (of your driveway), and because NY is a "Comparative Fault" state, the insurance companies will likely claim "Dual Negligence." In other words, you are both at fault. Therefore, your insurance company will likely take care of you and the other drivers' insurance will take care of him.

The saving grace is that nobody was hurt. Good luck.

What did the police report say?
It appears that the van was at fault by backing up on a one way street but insurance companies are pros at finding reasons not to pay, Glad no one was hurt.
The one big advantage of newer vehicles (if you can afford them) are the many new safety features.
I have a external dash cam for both front and rear in my Q70 along with the back up and front cameras that came standard. The wife's 2019 Benz has blind spot warnings which I will have on my next vehicle. Hopefully a Model S Tesla or a Benz?

Yeah, so the police report will just have our statements. It’ll likely say that we were both going reverse without really making a determination of fault.

ILM-NC is correct, that ny is a comparative fault state, but im hoping that , with the video, agents would see that I was operating with reasonable prudence and care while the other driver was basically yeeting his benz in the wrong direction.

Can't really imagine the white vehicle not being at fault. I'd think you no longer have right of way once you start traveling in reverse on a one way street.

I also can't really imagine your insurance company not trying to screw you and assign some % of the blame.

I dont see how this could be your fault. It looks like that guy was FLOORING it in reverse going the wrong direction!
Did he give a reason? wtf was he doing?!

You were backing out of a driveway with extreme caution, and he was barreling down the street backwards, the wrong wan on a one-way street. How is it anything but his fault?

Man, he smacked into you hard. That sucks.

He is clearly at fault. If it is a one way street you don't expect traffic to come from the opposite direction of flow.

Totally their fault. Not reasonable to expect a car to be flying back words down a one way street. Not much nice to say about the person driving it but I'm sure you know. He also sounds like one of those scumbags that like to just tell people whatever they want to hear to get out of what they have done or to get what they want. Make it as painful as possible for them if you can.

I'm confused. Someone just happened to be filming you backing out of your driveway from across the street?

Sorry about what happened. As far as I'm concerned, the other drive is 100% at fault.
