Got in an accident...who would you say was at fault? (VIDEO)
In the 2 states I have lived in, WA and AZ, it is totally illegal to travel in reverse on a public roadway. In certain circumstances, a police officer would tolerate a person slightly backing up to let someone through, but the law explicitly prohibits travel in reverse.
So this guy would definitely be 100% at fault according to our laws.
I would be surprised if NY didn't have a similar law.

For those who are interested, here’s an update.
Spoke with the other driver’s insurance company. Initially, the agent managing the claim said they will assume only 30% responsibility. I was pretty pissed before realizing they were only going off their driver’s statement. They didn’t actually see any of my evidence. I immediately sent them the video and pictures following the call. An hour later: “We’re going to assume 100% responsibility”
So at this point Im getting the feeling that they may total it out. 2008 G37s coupe w/ 97k on the odo. This would be a kind of a crappy outcome as they’re probably going to lowball at like 6-7k. in terms of aftermarket parts ive got

aftermarket wheels
it was in pretty decent condition in terms of paint and interior.
I kinda hope they pay to repair it, but the damages seem pretty severe. Aigh

How significant is the damage? If the car is driveable get at least 3 estimates yourself.
12 year old car with 100K miles isn't helping you either. If you've done recent maintenance - brakes, tires, and other high cost maint, present the receipts, that may help you.
Others will hopefully chime in on how to negotiate a total value. Also, a buy back/repair might be a good idea if there's no frame damage.

Thanks for the update. I suggest you document everything: who you spoke to and when, what was said, etc. DO NOT SIGN or AGREE TO ANYTHING IMMEDIATELY. The "at fault" insurance adjuster is agreeing to 100% liability: get that IN WRITING.
The "at fault" insurance company will definitely low ball the value. You (and maybe your insurance company) can negotiate for a higher valuation. But you will likely only net what the "blue book" valuation is at the time of the loss. Any mods to your car are, typically, on your dime and thus not covered.
Faking a potential injury after the fact will likely fall on deaf ears. You didn't seek immediate medical attention and likely didn't go to the doctor shortly thereafter (as a result of the accident). This does not preclude you from seeking medical attention should you have legitimate concerns...

Just hope they total it out and give you a fair amount. Take the money and buy it back if you really want the car that bad. If not just put it towards a 2010 or newer G or something else newer. Take your stuff off the car and keep it if you plan on getting another G. Just run to the jumkyard or tirerack and buy the cheapest steel wheels and tires and switch it out before you turn it in. If they don't total it out just make sure you take it to an Infiniti certified body shop and contact a lawyer that deals with diminished value claims. https://collision.infinitiusa.com/ce...epair-network/
they're insurance got you a rental car right? certainly don't settle quickly, think it over, look at their offer and look at some replacement comps compared to what they will show you. I always get a higher offer that way. The shorter time they settle in, the better the adjuster looks to his boss. They're also paying for a rental car for that much longer (and make sure it's a comparable rental car, not some POS).
If you don't like the offer, don't hesitate to involve your insurance company. It won't ding your record and they are there to work for you. I usually call my agent to ask his opinion too, he's been doing insurance for 25 years so has seen it all and often gives some good advice.

I agree with Joslo, get a few estimates. Also, I checked on auto trader and the prices for good G's even with high mileage .>100K are still more than $10K. Two years ago I was T-boned by a truck in my Honda S2000 and the insurance company paid $9K to get the car repaired using all new Honda parts. My driver's door was replaced, the rear internal/external quarter panel was replaced and repainted. The car was in the shop for 3 month's, awaiting parts, but the finished product is perfect.
