Those who are telling you to wait are giving you bad advise. What is there to wait for? The only upfront cost to you will be a rental and your deductable. Consider:

Even if the other insurance companies attempt to avoid paying, and your insurance cannot collect, you can still sue them. From the sounds of it, the case would be easily proven in court.

If you drive around a wrecked car and get in another accident, your headaches will exponentially increase.

At this point you do not know if there are potential safety issues. Why risk your life?

The car looks ugly wrecked...

Yes it sucks you have to pay immediately out of pocket; it seems unfair. But think of the situation objectively. The advantages outweight any potential 'loss' and, possibly the bigest factor I did not see mentioned, is your insurance company benefites to collect on your behalf... They are still paying the majority of the repair bill otherwise.

Take it to the best shop available and get the work done right!

Also depends on if you got hurt or not. If not and you are not planning on making a medical claim, the other company will usually be in a hurry to settle out to avoid you changing your mind.

Hey Guys,

thanks for all the replies, you've guys have been awesome.

Quick question: If I'm going through my insurance, do I have the option of telling them exactly what I need fixed or do they decide through themselves?

Another question - I need to replace the front (because the tire hit it and knocked it loose according to the report) and rear bumper, and trunk, is it possible to order a 2011 Sports bumper instead? I mean why wouldn't I be able to since it'll cost around the same amount, as my '08 sport bumper, correct? Also, I'm worried because I have a custom box in the trunk and I'm worried it might be damaged, albeit no visible marks or rattling but I've always heard horror stories of parts being messed up in the future. It'll be nice to have some security.

To all these cars with mods - how would you guys go about getting reimbursed for your mods through insurance, hopefully that'll never ever happen to you guys on this forum but, how would you go through the legistics of it? lol sorry for all the questions my insurance agent is being very very unclear.

Usually if you are repairing damages not related to the same incident, you will have to file separate claims. The shops (unless you know them well) and ins company will not let you get by with just 1 deductible. Plus the cost of repairing damages not related from the accident can't be collected from the at-fault party.

The shop will sent a damage assessment and a adjuster will go out to look at the damages. The keyword is "making you whole" meaning getting the car back to pre-accident condition.

Having said that, making you whole does not include getting a sports bumper. That is seen as an upgrade. Even if you offer to pay the difference, they still won't do it. I have tried. Again, your relationship with the repair shop matters in this case.

Any mods will be included in your policy as "accessory" coverage. unless you specifically paid extra to insure these items, most policy has a generic $1000 amount that covers these things. If that's not enough, you are SOL.

Insurance agent is the most useless person in this whole thing. My car was in a big accident. My agent didn't even know my car was in the shop for 1 month, we had major medicals. My claim was handled directly with Claim Center (Allstate). My agent is only responsible to see me the products. Claims go thru the 800 number.

Amen to that

also this is pretty much your best bet. Insurance will not cover for anything that was not originally on your car. They will restore your car to your original before-accident condition. And they will also not cover any aftermarket parts unless you have them covered in your policy as well. I would suggest talking to your shop about what you want to do. I am prettttyyy sure they have some tricks up their sleeves to make it work.

The amazing thing is, the pick-up truck behind me was barely working - front bumper caved in, leaking fluids, broken radiator.
Prius - totaled.
Work Truck - Severely damaged front and rear bumper
Compact car - totaled.

Granted I was the first car, I was amazed to see how little damage I took in. It's noticable, but nothing came off or hanging or anything (not even my license plate), no major issues other than a misaligned bumper and many deep scratches. My tailights don't have scratches on them. Everybody later was shocked and congratulated me on having an amazing "tank" of a car. (Pics coming)

After being Chris Browned, I can't help marvel at the fact she still looks great! I drove a Civic Coupe before this and I don't even want to think what would've happened.

Anyways, so process of insurance has been a pain and this is where I seek out your help.

My insurance agent hasn't been much help and it's really unclear what's he's been saying but here are my options

1) I wait it out for another couple weeks-6 months for all the insurance companies finish with their reports.

2) I go through our own insurance.

There are advantages and disadvantages to both which I assume most of you guys are aware of and I wish to know which route you guys would take. I'm having a difficult time making a decision.

you take it into a bodyshop and they'll handle everything for you. need a good shop to take your car to? i have a good one in SF

Your insurance will fix everything damaged in the wreck (not accident because a 5 car pile up like this is 100% avoidable). If the body shop says it's damaged from the impact, insurance won't argue with them. It's just not worth it.

You can order sport bumpers instead, but your insurance will only pay for what your vehicle came with from the factory. If you want sport bumpers instead, just tell the body shop. You'll have to pay the difference, but most body shops will be happy to do that for you.

As far as items in your trunk go, check your policy. They may be included, they may not.

After a wreck, insurance only pays to put your vehicle back in it's original condition. They will pay for an OEM wheel and tire, but not an aftermarket one. They'll pay for OE sway bars, but not Stillen bars. Typically, you pay the difference and the body shop buys the ones you want instead. There are ways to get your aftermarket parts covered by your policy, but it'll cost you more. You shouldn't include FI in your list of mods. You can almost always get pinned with FI being a factor in the wreck, and insurance companies look at that the same way they look at you admitting that you swerved into the other lane and hit the other guy. If it's factory, you're fine; if it's aftermarket, you're asking for trouble.

Once again guys, greatly appreciating all your comments and you guys are making this a lot easier for me. So I'll probably speak to my insurance agent tomorrow about going through with fixing my car and stuff and to my local guys

Xlack and Weiboy - I would love a recommendation! (Why is the NorCal forum so dead btw?)

One thing that might make a big difference is the policce report (provided one was created). When a guy decided to do a u-turn directly in front of me on a residential street and I t-boned him, he was arguing that it was my fault. ??? Anyway, my insurance was going to charge me my deductible since the other guy's insurance said he wouldn't take responsibility. However, the second the police report came out, the guy's insurance called me directly and said they would cover it. I never saw the police report (as here in TN we have to go down to the courthouse and pay a fee for a copy of it), but obviously it was clear enough in there who was at fault. I would expect the same to happen for this situation as well, given that you were hit from behind. Plus waiting for a few days to get the report is not as bad as waiting for all of the insurance companies to battle it out.

Anyway, just something to consider.
