Concern over fuel pump assembly top hat

I ordered a fuel pump assembly already modified and with an upgraded fuel pump so I can skip out on doing the work and have a drop-in replacement. The moment I took it out of the box I realized it had a slant on the top hat and I've never taken mine out of my car so I wasn't sure if that was normal. I sent a picture to the guy who made it, as well as my tuner.

The tuner replied telling me the top hat is damaged and I should have him replace it with one that isn't. I sent another email to the guy who made it asking for a return label and a new one to be sent out without damage. This is his reply:

It’s an issue on 370z because they are longer. CJM made a billet top hat for the 370z, but never had an issue on the shorter rod g37’s

With the countless g37 and 370z pumps I’ve built, not 1 g37 had ever had an issue of the top hat snapping, whereas many 370z’s have snapped.

I let my tuner know what he said, and the tuner told me it's my car not his and do what I think is right.

What do you guys think is right lol? Here's an image of the assembly:

I can either use it in the car, or tell him again to replace it and provide a return label.. and possibly chargeback the entire thing and sell it if he isn't willing to cooperate.

EDIT: This is time sensitive because I need to return my core for a refund.

Here's an update... I didn't expect the fuel pump person to respond so quickly but they did. I asked if they were declining my request and they told me to send it back, along with a screenshot of the shipping receipt.. and they will refund the shipping and replace the top hat.

So now I wait for them to receive the package, send another one out.. and we can go from there.

It's possible that with the assembly leaning like that the fuel level sensor wont read properly.
It will still read however it will show FULL at maybe 3/4s due to the lean it has. It would also mean there might be a possibility of you running out of gas because the new level would read slightly higher.

Performance wise it will still work, installer just needs to be a bit more careful with these if he wants positive reviews.

I'd be the installer. I figure you mean the modder. USPS picked up the package today. Now I'm just waiting for it to arrive to him and waiting for the new one.. as well as the refund he promised me for return shipping to send the faulty unit back.
