Damn, first big ticket in years

Hey Guys, I was driving down Rexdale blvd and got nabbed at 43 over. I know a tad fast. Anyone had a big ticket like that and got out of it. Any ideas how I can fight it. Something tells me they won't go easy on me going that fast? Anyone have any good xcopper advice or anthing really. I had such a clean reacord

Just take it to court hopefully the judge will see your driving record and give you some sort of break. Some times they will send you to driving school and give you a reduced or defered sentence. If not just remember you broke the law and it's time to pay. I hope it makes you think twice before doing something stupid in the future.

Oh and on a side note in traffic court I always did well by not lawyering up. I tried to look respectful but not too nice. Judges don't care much for douche bags with money that lawyer up when they get into trouble. Be remorseful and make it clear you know what you did was dumb. Own up and take responsibility. Judges like that. There will always be those judges that will set an example of you but thats the breaks. Good luck.

The court doesn't send u to school up here in Canada.

First thing you do, go to the office and put it to the court, choose the option 3 for challenging the cop's evident.

When the ticket arrive, request for disclosure.

Changing court date also increase the chance for the cop to be no show.

And then there is something called Canadian Charter of Rights and Freedoms section 11(b) for unreasonable lengthy delay for trial. If your trial date is like more than 8 months away from the offense date due to no fault of your own (changing date will waive this right of yours).

P.S. Demerit point does not affect your insurance, they look at the numbers of convictions, minor or major. For most of the insurance companies, speeding 43 km/h over is a minor conviction, and will have the same consequence as speeding 1 km/h over. So if you really care about the insurance consequences and not really the face value of the ticket, your ultimate goal is to completely drop the ticket.

Oh he is in Canada, I have no clue what GTA means.................and since I was doing this on my phone I didn't see this was in the Canada section, sorry! Still slow your a** down! lol

Thanks Kenny, great advice and web sites. Everyone else who just comments, no help as usual. I will study up and see how it goes.

As for speeding being stupid if it's uncontrolled yes but moderation is the key. I would love to follow you around and see exactly how you drive.

I didn't buy a G37 to drive like a grandma.

That should have been reckless with an arrest, not just a ticket.

Were you clocked wrong? I don't see that in question here. You just admitted what you did, put on your big-boy undies and grow up.

Wow, that is funny, didn't your mommy every tell you if you don't have anything nice to say, don't say it. Don't comment if you don't have anything constructive that will help. Again, I would love to follow your car for a day and see if you drive the speed limit. Go buy yourself a Hyundai if you can't handle the speed of a G.

chillax guys... the difference between a clean record or not is the difference between you are caught or not, everybody speeds at least once in their life.

I am not promoting reckless driving, but to be honest most of the people drive somewhat over the speed limit on a nice sunny summer day.

OP, I would study this up and fight it myself if I am you, since you have a clean record and this is not a major ticket. When all things fail, the crown will offer you a plea bargain to reduce your charge anyways.

Just because the G can go fast, doesn't mean everyone should have lapses in judgement and speed 40+ mph over the speed limit all the time. You HAD a clean record, but by your posts in this thread it seems it's just because you haven't been caught.

Look, if you want to drive around everywhere speeding because you can "handle" the racecar speed of the G, go for it, I don't care and I don't think anyone else cares if you do. hopefully you don't kill yourself or someone else in the process though. Please don't say people should speed if they own a G or should go buy a Hyundai if they don't...that's just borderline MR.

I still hope you get it reduced, but I will refer to my comment above that I thiefed from BB.

Let's see you go on a public forum whining about a ticket for 43 over, asking how to get it reduced or worked with?

Then you further whine that you had such a clean record.

It's not like you were doing 5 or 10 over like a lot of drivers do.. What was the limit on that road?

If he had of been caught doing 50 over, in Ontario where he lives, he would have lost the car, licence suspension and a hefty (upto $10,000) fine.

I've seen the signs on the QEW.

By the way, here 26+ over IS reckless ticketing speed. It depends, if you are doing 46mph in a residential area (25 a lot of times) you deserve reckless charges. It really doesn't matter if YOU call it reckless or not. The ILCS (here) and the officer call it that.

Here it is not called reckless. It's called speeding until we exceed 50km/h over at which point it's called Careless Driving.

I am not attempting to defend his actions. I just wanted to make it clear that he wasn't driving 43MPH over the speed limit (as Mattster posted). He broke the law and was caught. 103km/h on a 60km/h roadway is still bad, accidental or otherwise.
