So they tried to rip me off....Please Read

First, special thanks to a friendly sales rep on this site who helped me clear some things up...If you dont mind I'd like to share my story as I'm about as angry as can be with what went down...I also have no problems mentioning your name as a real stand up guy for taking the time to listen to my scenario...

On Wednesday April 23rd I signed a lease agreement with a certain Infiniti dealership in the PA area...My lease agreement was set at a monthly payment of $498 per month...I assumed delivery of the car on that date and drove off the lot with the signed contract in hand...The only thing they asked was that I do a "courtesy trade" with my private buyer...Meaning they would handle all of the paperwork for me and the private buyer...Which would assure them that my old Infiniti loan on my G35 coupe would be paid off in full...

Fast forward to last night April 29th...Myself and my private buyer and his girlfriend meet at this particular dealership...The finance manager informs me that I'll be signing some things first, and then it would be my buyers turn...My sales guy is nowhere to be found...Finance manager sits me down and says everything is great...However, some hits came back on my credit report so instead of Tier 0 credit I'm now a Tier 2 (698)...So my new monthly payment is $581 per month!!!

I informed him that my sales guy NEVER mentioned anything about a new credit app...And that I even asked my guy on 3 seperate occasions if he was POSITIVE that I qualified for tier 0 because I knew I had some defaults back in my college days...After 30 minutes of me explaining that I never would have assumed delivery if I knew a change was possible he goes to speak with his manager...He comes back saying they can get me in at Tier 1 and my monthly will be $565...And that they wont complete the trade with my private buyer until I sign...I left the dealership and made a private exchange with my buyer of certified check, keys, and notarized bill of sale...

I've been told that they have absolutely no leg to stand on here...And that they need to honor my original contract, or come pick up the car "now used with 500 miles on it" and pay me back every last penny of my deposit...

Anyone ever experience this before? I'm considering seeking an attorney as I'm furious at what they've tried to pull over on me...Thoughts?

I would think that if you have a signed lease agreement for Tier 0, you should be fine and they have no leg to stand on.

wow crazy... I hope things turn out for you well...

If it was me... (and I dont understand your story 100% due to scanning) but I would drive the car as much as possible... then if they didnt honor the original paperwork/deal... Id walk away from the deal. Make them take a hit on a used G37 now since there trying to change things up on ya...

Walk away and tell them to keep the car. Since they already tried to be slick with you, they don't deserve your business.
Can I ask which dealership in PA this happend?

Wow! I would do as some of the others said and return the car. That's a pretty low thing to do, especially coming from a supposedly high-end dealership.

No need to call the attorney..unless they escalate it.

You've signed a contract and it's done. If they keep insisting on renegging, threaten to return the car.

The nerve...

Yea, you both signed the contract for tier 0, nothing to worry about. I don't think they'd want to take a used G37 back with 500+ miles AND somehow try to get around the contract.

Was there anything on the contract that even hinted on "terms can change depending on final credit approval/financing" etc? I had a friend have the same thing happen with a Toyota dealership - the dealership took their now "used" car back when she wouldn't agree to the changes. They gave her trade in back. Either way - it's a really low thing to try to pull....

I've heard of some people who've leased and recieved notices in the mail weeks later that they "owe" additional money because they got bumped down to Tier 2. I made sure when I was signing mine that I was good to go and wouldn't be expecting anything in the mail. I paid my entire lease upfront and haven't recieved anything, thankfully!

why wouldn't they take it back? dealerships do that all the time ,they push people into cars and say "just drive it home tonight" before credit/banks are even finalized and have to take cars back due to credit.
If you didn't know dealerships (on our level) make a big chunk of their money off used cars, they will actually make more because they will keep whatever he put down and take their car back and just sell it again.

I would imagine that if I were to bring it back...They would have to give me back every last penny of my deposit...Since they were unable to stick to the agreed upon pricing...
