Steering Wheel Tilt

I'd love to get some opinions on this. 3 weeks ago, my 2009 G37 suddenly spewed smoke/steam at a stop light. Long story short, I had to get a tow to my usual car shop. After a lot of back and forth with the warranty company, the best solution has been to install a new engine. So far so good. I got my car back yesterday and it drives well. However, my steering wheel tilt is now broken and it remains at its lowest position which for me, is very uncomfortable to drive with. I can push the steering wheel up manually but it just falls back to the lowest slot. You can feel that something is broken. The telescopic mechanism works though!
I called the shop and they claim it was nothing to do with them. In fact, their guy apparently commented on how low the steering while was set at when the car first arrived. I've been going to this shop for several years and trust them. So, the fault is with the towing company, right? The car was loaded onto a flatbed truck but when we got to the shop, I just left them at it and walked home. In other words, the last time I was in the car before I got it back, was just before the towing company arrived to tow the car.
What's the most likely cause of this issue?
