Yes, that is the TEIN EDFC controller in the ash tray. I'm sporting Tein Flex coilovers. I provided a link to a review thread of my suspension a couple posts up if you're interested.
The shift **** can get hot, but it's not too bad. If I know I am going to be out of the car for a long period of time, I usually just throw something over it. If I were a big ballar, I'd be rocking the authentic TK shift **** cover, though...

Short answer - yes.
There is a way to prevent this from happening when removing the seats, as they are equipped with airbags. It is a couple resistors that get connected to the airbag wiring harness. I have done this before with my 350Z and avoided triggering the dash light. However, since I replaced the steering wheel as well, I knew I would get a warning light regardless, so I didn't even bother with that step and just decided to live with the warning light.
There is probably a way to get it to shut off, but I haven't tried to figure it out.
