Quesion on previous damage

Quesion on previous damage

We got our 08 G37 on 12-26-2009.
And when I took my car in for some service yesterday 05-25 the service manager told me he could tell that the car had been in a accident that the dealership that I bought it at didn't tell us about.
It has left rear quarter panel and rear bumper fixed.
I got a carfax report (I know I should of did that at time of purchase) and it showed that it was in an accident and after it was traded in did a complete service check on it.
My question is do we have any recourse against the dealership in not disclosing the fact it was in an accident on such a hi dollar purchase or are we out of luck?

there is no law that requires a dealer to tell you of accident history. you already stated in your post what you should have done before purchasing the car.

Not exactly....

Dealerships are required to disclose material known facts about a used vehicle such as if the vehicle was:
  • involved in a prior accident (that caused substantial damage)
  • it was a prior rental vehicle
  • a lemon law buy back (the vehicle was repurchased by either manufacturer or dealer under the lemon law because of a defect)
  • odometer readings not accurate, etc.
They are also prohibited from misrepresenting facts about the vehicle's history (such as its never been in an accident, it was a trade vehicle (when it was a rental), etc.

The problem you will have is the damage... If it was repaired from a minor fender bender this may not be something they have to disclose... you would need to reseach how the law defines "substantial damage".

the only time a dealer has to disclose accident history is if the damage was severe enough to total a car resulting in a salvage title. the other things you listed have nothing to do with accident history.

They told use that it only had one owner we fond out it had two and the right rear quarter panel was replace.
They also had to fix a bent rim on it when we first got the car but it was on the front right.
And it has some rust bout the size of this line ______ and bout three times thicker i know small but rust non the lest.
And now there are rubbing on the rear bumper and the trunk meet.
Dont get me wrong I love this car but if the dealer did use wrong i will take the car back and be done with it.

Good luck proving that the dealership knew about the accident. It's possible that they had no clue about the accident, so they can't be held liable even if there is some law that exists that says they have to disclose known issues such as accidents.

when i got the carfax on it the dealership did a complete checkup on it.

Carfax is not even 100%

I would run both Autocheck + Carfax before purchasing a car.

But you said that you got the Carfax after the fact. So even if the dealership is liable (which probably varies from state to state), you'd have to somehow prove that they knew before they sold it to you.

I just contacted the better business bureau and they stated (in California) they have to tell you of accidents.

I know they lied about having one owner.
So if they lied about that they knew about the damage.
So me and the wife went to the dealership to give them hell and when we pull up to it they closed down the dealership and it was a Nissan dealership a big one to boot so now my work got a lot harder.
