New owner needs serious help. Possible Lemon?

New owner needs serious help. Possible Lemon?

So here's the story. I found a G37 locally that had 13,000 miles on it and had just been traded in. The day it was traded in, I went and test drove it. The car is fully loaded. Its a G37S with all the packages and 4 wheel active steer.

I fell in love with the car and it was in great shape so I decided it was what I wanted. I drove it two more times before I gave the final go ahead that I was going to purchase the car. I came in to the dealership this last thursday and my sales guy told me he was going to align the car and get it ready, and that it would be ready on the coming monday. I gave them my credit card for a deposit and everything was set. I told him when I came in monday that the few minor scratches and curb rash should be fixed and the car should be ready to go. He agreed and said all I would need to do is come in and sign the paperwork.

I came back to pick up the car on monday, signed all the papers and they brought the car around. I was waiting to get in it when I noticed that the exhaust had a new rattle in it that I had never heard. It was blatantly obvious and I pointed it out to the sales guy. He took it back to service and they said that there was some kind of recall and it was a known issue. they were going to order a new muffler and have it in for the following monday, and that i would have to wait a week with this rattle. already i was pissed off.

Then I get in the car and notice that the 4WAS (4 wheel active steer) light is on, the VDC Off light is on solid and I cant get it to turn off (yes i tried hitting the button) and the Slip light are on solid. I cycled the ignition a few times to see if it was a fluke. I showed the salesman, and he again took it in to the service department. this time he came back and told me that the wheels had to calibrate with the 4 wheel steering sensor and i had to drive it for 45 or 50 miles and everything would be fine. So i took delivery of the car. as I'm leaving the parking lot, I notice the steering wheel is cocked to the left about 15 degrees and the car is holding straight on the road. I call the sales guy, and he gets frustrated and says to bring the car back the next day and they would diagnose the problem.

Come back the next day, wait 5 hours for them to tell me that now they have now figured out it is the ABS Actuator. They tell me they had to order the part and that it would be fixed on monday along with the muffler.

Next day (now the second day of owning the car) my sales guy calls and tells me to bring it in on thursday and that they will have everything taken care of ahead of schedule.

I take the car in this morning, they start working on it and inform me that they have no idea what is going on with the car, and that they had to call Infiniti Technical support and open some kind of technical case on the car. They say it can take anywhere from a few days to a few weeks to fix. and in the mean time im driving a G35...

im ****ing pissed. I maintained my composure with the dealerhship, but i just payed 40,000 dollars for a car that is a lemon. I havent even had it 4 days and its spent 3 of the 4 days at the infiniti dealer.

does anybody know what could possibly be going on with this? anyone ever heard of anything like this? the infiniti dealer isnt giving me nearly enough information, and they wont let me talk to the mechanic to figure out exactly whats going on. everytime i go in there they seem to put me in contact with someone who knows even less of whats going on that the last guy. I just want my car back and working.

it was perfect when i test drove it, and now all of a sudden these things are popping up.

Im really sorry to here that; hopefully they can fix it- if not, at least they can accomodate you by putting your money into another car or maybe even a refund. The muffler/exhaust rattle has been a pretty known issue but the other problems don't sound familiar/normal. maybe they can reset the ecu for you to see if the vdc and 4was lights turn off. As for the steering wheel- that is really dangerous... make a big point of that to the dealer.

Looks like your car is coming close to qualifying per the Lemon law. Hope your situation gets better.

Too late to stop payment on your check...?

...if not, stop that bad boy first thing...although I'm sometimes reactionary, I'd look for a lemon law lawyer ASAP...have him/her talk to the dealer on your behalf - nip this $hit in the bud. Good luck!

EXACTLY WHAT WAS I THINKING!!!!!!!!!!!!!! (maybe he carried over a previous loan?)

Bro, for that price, you could have bought one new, interior still covered in plastic, fully loaded. It's late in the game and the '09's are two months away....

I hope it gets worked out for you!!!! Good luck bro! It could be worse, you could be with no wheels at all????? At least you get a loaner....

Ahh, after reading this thread I started getting stomach pains. I know when I bought my car used it had 12,000 miles and I was able to get it out the door for 37k (I tried 3 dealerships to try to get them to budge a little and lower the price on the new, but they wouldn't), fully loaded and got an additional 1,500 on my trade. Turns out the muffler was rattling, but they had no problem replacing it.

I did find a cigarette burn hole in the driver's side back seat armrest, I was livid. I immediately called the sales manager and bitched him out for 5 minutes before he said 2 words. Long story short, they fixed it and gave me a full tank of gas.

If you're really upset you should talk to the sales manager at the dealership and try to get a refund, if that doesn't happen, then a lawyer would be the next step if you want to take them to the cleaners.

well it was 39,995. If i bought the same car (same options) new, the MSRP would be 46,000.

should i try and get them to take the car back and just get a new one? I really dont want to spend anymore money, and the only option i'm willing to give up is the 4 wheel active steer.

Did you run the VIN number thru carfax?
I'm thinking it might have been in a significant front end accident....

i don't think you can lemon law a used car. your only option would have been to cancel the contract withing 72 hours. most states allow you to back out within 3 business days of signing a contract. hopefully you can get everything worked out and it wont give you any more problems.

+1 - exactly what i was thinking when I read this story. Please tell me you at least glanced at a carfax? there has to be a significant reason why someone would trade in a less than year old car. Hopefully in your case, it was just because they wanted to and not because it was a factory lemon or accident.

and $40K on a used G37? Yikes

My advice. Check Carfax. If the car was in an accident, get a lawyer to write a letter demanding rescission on the grounds they defrauded you by failing to disclose that the car was in a serious accident. I don't think the Lemon laws apply to used cars. Suing might be expensive and I don't know if you would be entitled to attorneys' fees if you won (Check your contract with the dealer and the state statutes on unfair business practices) -- but you might have to.
