Exclamation Funny thing happend to Alex@Autokits-X (advice)

I just got off the phone with Alex and he needed advice. Mine was somewhat harsh but I wanted to post thisso you guys see the kind of people we have in this business.

Alex recieves a phone call from a gentleman that was interested in buy the rear valence from Autokits-X. The guy insisted on paying over the phone via credit card. They kept exchanging calls and what not but Alex told him that he rather go through paypal bc something was fishy.

Gentleman says ok and to send him an invoice. Alex sends him the invoice to the provided paypal account and BEHOLD............ its a large company that already makes products for the G37 (which none have sold bc of very, very, poor fitment) hoods, kits, etc..... Now its clear why he wanted to make payment over the phone

Now here is the question from Alex. Should he sell them the valence, wait for them to copy them then take them to court and sue them (yes he knows the right people) or should he just deny the request and not send them ****

I still cant comprehend why these big companies copy crap from the small vendors that take the time to design and test the parts to assure perfect fitment

I think alex should draft a contract stating they cannot duplicate the product and the product is for personal use only, have the other person sign it via email/fax and sell them the product. This way he has a contact and if they breach it, a lot easier to sue.

Just sell it, if Alex refuses to sell now. They'll get someone else to buy on their behave.

Why couldn't the gentleman just make a new PayPal account with the credit card then there's no traces to the company he is working for? He wasn't very smart.

Per his request he did not want me to do that, but I believe that would be the best bet. Ill let him chime in. But if everyone knows who it is then we know not to buy from them

Nothing really Alex can do. If he refuses, someone will just buy it with a personal account. They will get one somehow.

He could send them one that purposly has bad fitment for them to make a mold of.

Yeah if they really want it they will be able to get it so he should just do everything possible to protect it and then go ahead and sell to him.

I think this is the best way to go...I agree that they will get it if they want to and if you pre-empt that by providing them with some kind of contract so that if/when the legal aspect DOES come up, he has what he needs.

And it really is rediculous how lazy some companies can be. Instead of actually doing the work themselves they just try to bum it off people actually doing the work

If Alex gives the go-ahead I would DEFINITELY put their name out there so that people know who they are. If he doesn't want that then so be it

Sad thing is, all they really have to do is like make a mold and change one little thing. Like add a fin, and legally it isnt copyright.
